Judgment: LC Muller v Bekker NO & Others (UM65/2019)

The applicant (the previous BRP of the close corporation in liquidation) approached the High Court of NWD, Mahikeng on an urgent basis seeking that the Section 417/418 enquiry be suspended pending the finalisation of a review application and /or the finalisation of the application for business rescue pending before this High Court.

The Court held that the history of the litigation by the applicant, where the applicant was the business rescue practitioner of the close corporation who eventually had it placed in voluntary liquidation, is clandestine by nature and granted a punitive cost order against the applicant.
