Judgment: S Khamissa & Others v The Master of the High Court

February 2020

Judgment: Case No: 049832/2017

In this matter, the Applicants sought a review of the appointment of the Second and Third Respondents as Joint Liquidators in Duro Pressings (Pty) Ltd (In Liquidation). The review arose because of two conflicting decisions pertaining to the same appointment were made and communicated to interested parties when the Master was functus officio.

The Court confirmed that the Master is a creature of statute and exercises a public power and performs a public function. The decision not to appoint the Second and Third Respondents was communicated to interested parties and thus final and irrevocable. The subsequent decision to appoint the Respondents was reviewed and set aside.

This judgment was kindly sent to us by Adv. J Suttner SC.
