Judgment: Moodliar & Others v Recycling and Economic Initiative of SA NPC

Attached a judgement from the SCA handed down today, dealing with the setting aside of a winding-up order and the resultant question of how the fees of the liquidators should be dealt with.

The Court concluded that in terms of the Companies Act 61 of 1973 and the Regulations, Liquidators are only entitled to their remuneration on the taxation and confirmation of the estate account.
