Judgment: K Knoop v C Gupta

This is an appeal from a Full Bench of the Gauteng Division of the High Court Pretoria sitting as court of first instance.
The appeal was upheld with costs and the Court found that the appellants were not validly removed from office as BRP’s, the directors were not entitled to nominate new BRP’s and the notices of termination of business rescue issued by the new BRP’s were invalid and of no force and effect.
