INSOL Publication: "Costs Assessment for Debt Collection Abroad"

On 4 August 2021, INSOL International published a book titled "Costs Assessment for Debt Collection Abroad" which considers the means and costs of recovering debts from creditors in 17 foreign jurisdictions ranging from Australia, Brazil, BVI, Cayman Islands, Croatia, France, Germany, Hong Kong, India, Mexico, Russia, Singapore, South Africa, Spain, The Netherlands, United Kingdom, and the United States of America.
The focus of the publication is on how an insolvency practitioner can go about both pursuing third party debt claims and seeking recognition abroad of a foreign enforcement order, and in each case what the typical costs of doing so will be and how a practitioner may seek to obtain funding for the incurrence of those costs.
This publication is a valuable resource for our members and for the broader insolvency and restructuring profession in collating – in a single publication – the different debt collection, costs principles and practical challenges that exist for insolvency practitioners in multiple jurisdictions. The publication will also enable practitioners and their advisors to assess whether the pursuit of debt recovery options is viable, depending on the nature and quantum of the claim involved, and for the purpose of enhancing the return for creditors as part of the conduct of a fair and efficient insolvency process.
