Interesting Judgment: W. Cawood N.O. v C. Murray N.O. and others

This judgment was handed down by a Full Bench in the High Court, Pretoria.

The Court found that it does not possess the inherent power to order that a Business Rescue Practitioner repay fees on account of misconduct. Such an order would be beyond the Court’s powers in terms of the principle of legality.
