Interesting Judgment: Kgoro Consortium & Another v Cedar Park Properties & Others

In this matter, the SCA was tasked with an appeal following the Court a quo’s dismissal of an application to place the company in business rescue as provided for in Section 131 of the Co’s Act.

In dismissing the appeal, the SCA confirmed the clear principles and requirements set out in the Oakdene-case for such an application.
