Interesting Judgment: Venter & Ramchandra v Alba Skrynwerkersgeboue

Please find attached the following judgment handed down in the High Court, Northern Cape Division, Kimberley.

The questions before the Court were:

  1. Whether the High Court had jurisdiction to adjudicate over a Section 69 warrant.
  2. Whether a Section 19 inventory is required if the entity was wound up by way of special resolution.
  3. The referral of the Respondent’s contravention in terms of Section 142(1), Section 142(2) and Section 145 to the National Prosecuting Authority.
  4. The court awarded a punitive cost order against the Respondent.
