Please find attached a Notice of Motion for a Declaratory Order regarding the following two aspects:

  1. In an insolvent estate that was voluntarily wound up by creditors and where there are no assets, the Master, Mahikeng requires proof that the shortfall has been collected from the members and the Memorandum of Incorporation before permission to advertise the Liquidation and Distribution account being granted and,
  2. In an insolvent estate where there are no assets the Master, Mahikeng requires that Master’s fees are paid on the collected shortfall.
