Update on the Application for a Declaratory Order

This is an update on the application for a Declaratory Order regarding the appointment of provisional liquidators as final liquidators after the first meeting of creditors where no claims have been proved.

The matter has been postponed for argument on the opposed roll of the 15th of June 2023, see attached order dated 4 November 2022.

Of importance is the order of 25 August 2022 (also attached) which clearly stipulates the following:

  1. The parties have by agreement indicated that this will be a test case and
  2. Pending the outcome of this application the status quo ante in so far as the appointment of liquidators and trustees will be maintained.
