Draft Order in Application for a Declarator

Please find attached the draft order that was made an order of the High Court yesterday regarding the Master, Mahikeng’s interpretation of Sections 349 and 351(1) of the previous Companies Act and Section 153 read with the Third Schedule of the Insolvency Act as amended by Government Gazette 41224 of 3 November 2017.
