Interesting Judgment: Constantia Insurance Co. Ltd v the Master of the High Court Johannesburg & Others

Please find attached a judgment handed down by the SCA on the 13th of December 2022.
The judgment dealt with the test for an expungement of a claim by the Master in terms of Section 45 (3) of the Insolvency Act and the definition of “financial assistance” in Section 45 (1) of the Companies Act.
The appeal was dismissed with costs including the costs of two counsel.
