Interesting Judgment: ER Smith & Others v Master of the High Court & Another

Please find attached a judgment by the SCA handed down on the 8th of March 2023.

The Court found that the court a quo had erred in interpreting the wording of Section 417 and upheld the appeal with costs (including the costs of two counsel).
