This was an opposed application for the sequestration of the respondent’s estate following a nulla bona return of a warrant of execution.

The issue for determination was whether the respondent was insolvent within the meaning of the Insolvency Act and whether the application should be considered because of the dispute of claim.

The Court held that the estate of the respondent be placed into final sequestration.
