Interesting Judgment: RA Le Sueur v RR Stainton

Please find attached a judgment handed down by Annandale AJ in the High Court, Pietermaritzburg.

The application served before the Court as an opposed motion on the extended return date of a provisional order for sequestration.

The respondents opposed the granting of a final order of sequestration on the ground that the applicant had not shown that there was a reasonable belief that the sequestration of the joint estate would be to the advantage of creditors.

The Court was satisfied that the applicant had overcome this hurdle and granted a final sequestration order.
