Interesting Judgment: Nedbank v Pacinamix & Others

This judgment was handed down by Windell J on the 27th of November 2023.

The application was successfully brought in terms of Section 130 of the Companies Act. In paragraph 31 the Court stated that when subjected to an objective evaluation, the appointed Business Rescue Practitioner’s proposals were mere wishful thinking.

The First to Third respondents are to pay the costs de bonis propriis.
