On 14 April 2025, Manoim J in the High Court, Johannesburg, handed down the attached judgement.

The Court clarified that "creditor" in Section 360 is broadly defined, ensuring access rights for all genuine creditors, not just proven ones.

It also reinforced the principle that creditors can utilize Section 360 for purposes that extend beyond merely assisting the liquidation process, such as investigating potential claims against directors.
