Judgment: Poisonwood Investments Pty Ltd v Meyer van der Walt Incorporated and others

In this matter the applicant sought a declaratory order that funds held in trust by the first respondent did not vest in the insolvent estate of Silver Solutions 1206 CC.
The court found that the funds were for the benefit of the applicant and not the insolvent estate, ordering the release of the funds to the applicant. The second to fourth respondents were ordered to pay the costs of opposition.
