Judgment: A Moollajie & Another v The Master & Another

Attached a decision of the Western Cape High Court that deals with the remuneration of provisional trustees and final trustees.

The applicants, as provisional trustees, applied for a special fee due to the complexity of the insolvent estate.

The second respondent was appointed as a final trustee and contended that he is entitled to share in the special fee; the applicants disputed this contention. The Court ruled in favour of the applicants and awarded costs against the second respondent.
