Judgment: Land Bank v AM van Rensburg & Others

The attached judgment was handed down in the High Court, Eastern Cape Division by Cengani-Mbakaza AJ.
The applicant sought an order in terms of Section 33 of the Land and Agricultural Bank Act to attach and sell immovable properties of the Rynheath Trust, IT 23/2016 as payment of outstanding amounts.
The respondents disputed that any rights to the debts were ceded to Land Bank and that Land Bank lacked locus standi.
The Court found that the attack on the Land Bank's alleged lack of locus standi was merely a bare denial, unsupported by facts.
Judgment was granted in favour of the Land Bank.
