The attached judgment by Marion AJ of the High Court Pietermaritzburg dealt with two related applications that were heard and argued together.
Both applications turned on a point of law, namely whether the liquidation order issued on 30 May 2025 was valid or whether it was a nullity. In answering this question, the interpretation of Section 131 (6) of the Companies Act was considered and found that the provisional order had been validly granted and that the provisional liquidators were entitled to the relief sought.
