Judgment: Loomar Boerdery v ER Smith NO & Others

This is a judgment by Molitsoane J in the High Court, Bloemfontein and follows an application for the removal of the joint liquidators (first to third respondents) in Sandvet Pecans (Pty) Ltd (in liquidation).

The Court found that the application was premature as Section 379(2) provides that an interested party must apply to the Master of the High Court for the removal of liquidators and "if the Master fails" the High Court may be approached.
